This document establishes the general conditions of the contractual relationship for the sale of products offered on this website, owned and operated by TAKUMI BEAUTY GROUP, SL (hereinafter, "TAKUMI") with registered office at C/ Barcelona,32, Pol. Ind. Mas Gali CP: 08503, Gurb, registered in the Barcelona Mercantile Registry, Volume 40553, Folio 72, Sheet B 367093, with CIF: B-64644743, and the natural and/or legal persons (hereinafter, "CLIENT") who express their intention to purchase the products through an online order via this website.

These user orders constitute the specific conditions associated with these general conditions, which the CLIENT must accept electronically prior to purchasing the product. The CLIENT can access these conditions on the website to read, print, store, and accept them. These general conditions, together with the order of specific products made by the CLIENT, formalize the sales contract between TAKUMI and the CLIENT, who confirms having read, understood, and accepted these conditions. The CLIENT can always consult these general conditions through the website.

FIRST - OBJECT OF THE CONTRACT

Under these General Conditions, TAKUMI agrees to deliver to the CLIENT the products ordered through the website in exchange for a fixed price.

 By purchasing the products available on this website, the CLIENT declares that:

 a) They are of legal age and have the capacity to contract.

b) They have read, understood, and accept these General Conditions of Contracting.

 

SECOND - AMENDMENT OF GENERAL CONDITIONS

TAKUMI reserves the right to modify these General Conditions at any time without prior notice to the CLIENT, who is responsible for reviewing them before purchasing any product available through the website. The General Conditions in effect at the time the CLIENT purchases the products shall apply.

THIRD - RIGHTS AND OBLIGATIONS OF TAKUMI

3.1 Delivery of the product: TAKUMI commits to delivering the product in perfect condition to the address indicated by the CLIENT in the order form. TAKUMI is not responsible for errors caused by incorrect or incomplete information provided by the CLIENT. Delivery time depends on the product characteristics (deliveries only within the European Union and Andorra). TAKUMI is not responsible for delays due to the transport agency or unforeseeable, uncontrollable events.

In case of production delays, TAKUMI will inform the CLIENT and communicate the expected delay by email or phone. The CLIENT may cancel the order or choose an alternative item. If no response is received, it is assumed the CLIENT wishes to wait. If the product cannot be supplied, TAKUMI will cancel the order and refund the full purchase price within 15 days, except for special conditions indicated in the product description.

3.2 Responsibility of TAKUMI: TAKUMI is not responsible for:

Errors or delays caused by the CLIENT entering data incorrectly, slow or failed confirmation receipt, or issues due to Internet problems, force majeure, or unforeseen contingencies. TAKUMI will assist the CLIENT to resolve issues promptly.

Errors or damage caused by inefficient or bad faith use by the CLIENT.

Non-operational or incorrect email addresses provided by the CLIENT.

3.3 Guarantees:

TAKUMI guarantees that all products comply with international and EU safety standards.

The product warranty is 24 months if used under normal conditions described in the product catalog. The warranty does not cover suitability for specific user problems.

Shipping costs to return defective products during the warranty period are borne by the CLIENT; TAKUMI covers the return shipping to the CLIENT.

RIGHT OF WITHDRAWAL

According to Article 103(c) of Legislative Royal Decree 1/2007, customized or personalized goods are exempt from the right of withdrawal.

FOURTH - RIGHTS AND OBLIGATIONS OF THE CLIENT

4.1 Payment: The CLIENT agrees to pay in advance for the requested product as follows:

4.1.1 Amount: The price of the requested product is as indicated on the website and in the CLIENT’s specific order. Prices exclude VAT, which is applied before checkout. Shipping costs are additional and must be communicated to the CLIENT before purchase.

4.1.2 Payment Methods:

  • Credit card via the website’s virtual POS. The CLIENT confirms authorization to use the card. Payments are subject to Spanish Law 19/2018.

  • Bank transfer.

4.2 CLIENT responsibility:

  • The CLIENT assumes all risk of damage, loss, or deterioration from the moment the product is delivered by the third-party carrier.

  • The CLIENT must check the product upon delivery and report any packaging issues immediately. Any damage discovered later must be reported within 24 hours of receipt.

FIFTH - LIABILITY

5.1 TAKUMI is not responsible for:

  • Any damage caused by the CLIENT or third parties on the website.

5.2 TAKUMI may suspend access without prior notice to secure responsibility for damages and will cooperate with authorities for illegal activities.

SIXTH - ELECTRONIC INVOICE

The CLIENT accepts electronic invoices for purchases. To request a paper invoice, email info@takumi.es.

SEVENTH - COPYRIGHT AND TRADEMARK

Website content, design, and programming are protected by copyright. Reproduction or distribution without TAKUMI’s consent is prohibited. Product trademarks belong to their legitimate owners. TAKUMI may link to third-party content, citing the source. Rights holders may request removal of references.

EIGHTH - JURISDICTION AND APPLICABLE LAW

These general conditions are governed by Spanish law. For non-consumer CLIENTS, disputes are submitted to the courts of Vic.

NINTH - NULLITY OF CLAUSES

If any clause is declared invalid, the remaining clauses remain in effect. TAKUMI may choose not to exercise rights without waiving them.

TENTH - ONLINE DISPUTE RESOLUTION

The European Commission provides an online dispute resolution platform: http://ec.europa.eu/consumers/adr/. Consumer CLIENTS may submit claims via this platform.

Shipping Policy

Delivery area

We deliver within the territory of the European Union and the Principality of Andorra.

Delivery times

Delivery times depend on the type of product. For made-to-order furniture, the production time may vary. If there is a delay in manufacturing, we will contact the customer by email or phone to inform them of the new delivery date. The customer may choose to wait, cancel the order or select an alternative product.

Product availability

If a product cannot be supplied due to lack of stock or any other reason, the customer will be informed and the order will be cancelled without penalty. The full amount will be refunded within a maximum of 15 days.

Shipping costs

Shipping costs are calculated according to the destination and the type of product. They will always be displayed before completing the purchase and will be itemised in the confirmation email.

Delivery address

The customer is responsible for providing a correct and complete address. TAKUMI is not responsible for delays or failed deliveries due to incorrect or incomplete information.

Order reception

The customer must check the condition of the packaging at the time of delivery and report any visible damage to the carrier. If, after opening the package, any damage or defect is detected, TAKUMI must be notified within 24 hours of receipt.

Warranties and defective products

If a product shows a manufacturing defect within the warranty period, shipping costs to our warehouse will be paid by the customer. The return shipment to the customer’s address will be covered by TAKUMI.

Right of withdrawal

The right of withdrawal does not apply to products manufactured specifically according to the customer’s choices or personalised products, in accordance with Article 103.c of Royal Legislative Decree 1/2007.
